Two Tractor Trailers Totalled

Early Friday morning two tractor trailers collided on Interstate 84.

According to police, the accident happened shortly after 4 a.m. on Interstate 84 eastbound between exits 66 and 67 in Vernon. They said that one tractor trailer truck was parked on the side of the highway while its driver, 45 year old Jonathan Oberko, of Bronx NY, was sleeping in the sleeper cab section.

Then a second truck, driven by 42 year old Artan Nika, of Peabody MA, moving eastbound on the highway in the right lane, drifted onto the shoulder section of the roadway, and collided with Oberko’s truck. The impact caused Nika’s truck to catch fire, which rapidly ran out of control.

Neither of the drivers was seriously injured and Nika said he was unhurt and refused medical attention at the scene, whereas Oberko reported non life threatening injuries and taken to Rockville Hospital for treatment.

Both sides of the highway were closed for about 40 minutes while fire crews worked to extinguish the fire but both rigs were totalled in the accident, and were towed away from the scene.

Eastbound lanes were reopened to traffic by 11:30 a.m.

Who is Responsible for Truck Accidents?

If you are ever in an accident with a semi or commercial truck, the first thing to do is to establish who is liable for the accident as it may not only be the driver, it could also be the company who owned the truck or who employed the driver.

Firstly it needs to be determined what relationship the driver had with the company, whether he or she was an independent contractor or an employee. This needs to be discovered to establish who should bear responsibility for the accident.

Usually truck companies can be held responsible for the acts of their drivers even in cases where the driver makes a mistake, such as falling asleep, if it can be proved the company was responsible for making the driver work long hours, or they knew he or she was not fit to drive.

Also the company is responsible for ensuring that the driver is qualified to drive. So should the driver have a poor record in terms of the previous accidents or if they have had traffic tickets for several offences in the past, hat is another reason for the company to take the responsibility.

Trucker Drives Over 1 Million Miles Accident Free

Connecticut truck driver Paul Brandon, aged 55, has been voted one of the country’s greatest truck drivers at the annual National Truck Driving Championships. He won in the contest’s 48-foot flatbed division.

According to his employer, Fedex, he has never had an accident, although he has driven over 1.1 million miles on every kind of rig which has ever been made.  According to Brandon, his safety record is due to being vigilant at all times which includes never taking his eyes off the road and never taking his hands off the wheel.

Brandon has been driving flatbeds for the past 14 years in and around Connecticut. He says they’re unique among rigs as there is a lot of addition labor required on top of driving such as securing the load with chains or tarps.

Motorcyclist Killed in Accident

Joel Cotto, 26, died Friday night after he was thrown off his motorcycle in an accident with a pick-up truck on Routes 8/25.

According to the incident report, the accident happened just before 11 p.m. near Exit 2, when Cotto, who was driving a 2007 Suzuki GSX 1300 motorcycle at high speed in the right lane, tried to pass a 2010 Chevrolet pick-up truck.

When Cotto tried to pass the truck, he hit the passenger side, causing him to lose control of his motorcycle which then struck a metal guide rail on the shoulder of the highway, throwing Cotto off and sending the bike skidding several hundred feet into the right lane.

The driver of the pick-up, who was uninjured, pulled over into the shoulder of the highway.

Cotto was pronounced dead at the scene by emergency responders.

The accident shut down the highway on the northbound side into the early Saturday and backed up part of Interstate 95 as a result.

The driver of the pick-up was not charged at the time of the incident and the case remains under investigation.

How to Drive Safely with Trucks on the Road

Truck week begins on September 1st so it is worth remembering that when you come across a truck on the road you need to drive with special care.

Firstly you have to allow safe road space for the truck’s size. Simple physics means that trucks, which can weigh 40 to 50 times that of the average sedan, take more distance to stop so don’t cut in front of trucks approaching traffic lights or out on the highway. If you see a truck with a “Do Not Overtake Turning Vehicle” sign on the rear it means they can legally turn from the second or third lane as needed, to safely get around a corner. Stay back and don’t move into the blind spot to the left and rear of the truck cab until they have safely negotiated the bend.

Next, if you are being passed by a truck, don’t increase your speed as this only increases the time involved for the truck to pass you. It is much better to ease up on the accelerator and by helping the truck pass safely you improve your own safety as well. And flash your headlights when the truck has passed to tell the driver when it’s safe for him or her to move back in.

GM Announces Recall Compensation Plan

GM Compensation

Lawyer Kenneth Feinberg, a compensation specialist, is to be in charge of the administration of the GM compensation scheme set up to pay out to the families and victims of those who had car accidents, due to the faulty switch in some GM cars.

Feinberg has met with the families to announce the details of the eligibility criteria and the process of calculating the amounts of compensation to the victims and family members.

Although he said that he knew that the money would not bring their loved ones back and nor would it cure those who have been left with permanent disabilities as a result of the accidents, he hoped that he would be able to ensure that they received awards which some had been fighting for for years.

Feinberg went on to say that the awards would be based on the anticipated future earnings of the victims, plus additional amounts for pain and suffering and to cover medical expenses. He confirmed that it would be he alone who would agree the amounts involved and that GM would not be able to appeal his decisions.

As GM gears up to pay out potentially hundreds of millions of dollars in damages, the company’s recall efforts continue. If you have suffered serious injuries as a result of a defective GM vehicle, please call our Connecticut I-95 accident attorneys at Hastings, Cohan, and Walsh, LLP, at (888) 244-5480 or contact us online today.

Can I sue a Bar, Restaurant, or Club for Drunk Driving Injury?

By now everyone knows that drinking and driving raises the chances of an automobile accident exponentially. The nightly news has no shortage of stories in which a drunk driver takes to the road and causes an accident which kills one or more innocent victims. Often times these drunken drivers had too much to drink at local bars, restaurants, or clubs. Some wonder if the victims of drunken drivers, or their families, can sue the owners and proprietors of such alcohol serving establishments which serve too much alcohol to a person who goes on to cause a drunken accident.

Every jurisdiction has its own individual regulations regarding how alcohol serving establishments should treat customers who seem to have had too much to drink. In most cases alcohol serving establishments are to refuse service to customers that appear to be drunk. As such, in many jurisdictions across the country those who have been injured in a drunken driving accident, and the survivors of those who have been killed, can take the proprietors of such establishments to court.

It can be difficult to prove that an establishment should have refused service to a drunken patron, specifically because attorneys must first be proven that the establishment had reason to believe that the patron had too much to drink. It is best to work with an experienced law firm when bringing forth such a complicated case.

If you believe that your serious injury, which you sustained in an accident with a drunken driver, may have been as a result of an alcohol serving establishments’ negligence, contact our office is immediately.
